Who are the MIBs?
An ITAA Member (whether employee, civil servant or independent) who does not work in a firm but for a single actor in the commercial and non-commercial sector and exclusively exercises his/her functions according to the procedures specific to this actor.
Belgian and international tax authorities are considerably intensifying their transfer pricing enforcement efforts. Dedicated specialist teams are being established, data mining and AI tools are increasingly deployed, documentation requirements are becoming more stringent, cross-border information exchange is expanding and penalties are being applied more rigorously. As a result, companies are confronted with audits that are faster, more detailed, more consistent and aligned with the business.
During this session we’ll cover the following:
• Introduction to Transfer Pricing in Belgium
Overview of the Belgian Transfer Pricing framework, documentation requirements, and interaction with the tax authorities.
• Insights from Transfer Pricing Audits
Key focus areas observed during audits, common challenges, and practical lessons learned.
• Characterization of an Entity
The importance of accurate functional analysis and how entity characterization impacts transfer pricing outcomes.
• Financial Transactions
The increasing scrutiny on intercompany financing, loans, guarantees, and cash pooling arrangements.
